These Terms of Sale apply to any order placed by a consumer (a natural person acting for purposes outside their trade, business, or profession) on this website. By completing an order, the buyer accepts these terms in full. The seller reserves the right to modify these terms at any time; the version in force at the time of the order governs that order.
3. Products and pricing
All prices are shown in euros (€) inclusive of applicable VAT. Prices do not include shipping costs, which are calculated and displayed before order confirmation. The seller reserves the right to modify prices at any time. However, the price applicable to an order is the price displayed at the time of order confirmation.
Product descriptions, photographs, and ingredient lists are provided for informational purposes. Cosmetic products are intended for external use only. Individual results may vary. No product on this website constitutes a medical claim, diagnosis, or treatment.
4. Order process
An order is placed when the buyer completes the checkout process and receives an order confirmation by email. The confirmation constitutes acceptance of the order by the seller. The seller reserves the right to refuse or cancel any order in cases of suspected fraud, stock unavailability, or payment errors.
All orders are subject to stock availability. In the event that a product is unavailable after an order is confirmed, the buyer will be notified promptly and offered a full refund or substitution.
5. Payment
Accepted payment methods are displayed at checkout. Payment is due in full at the time of order. The seller uses third-party payment processors and does not store card information. All transactions are encrypted via TLS. The seller is not liable for payment processing errors caused by third-party services.
6. Delivery
Products are delivered to the address specified by the buyer at checkout. Delivery timeframes are indicative and begin from the date of order confirmation. The seller is not liable for delays caused by third-party carriers, customs, or force majeure events. Risk of loss transfers to the buyer upon delivery to the carrier.
The seller ships within the European Union. International orders outside the EU may be subject to customs duties and taxes, which are the buyer's sole responsibility.
7. Right of withdrawal
In accordance with EU Directive 2011/83/EU on consumer rights, buyers have the right to withdraw from a distance contract within 14 days of receiving their order, without giving any reason. To exercise this right, the buyer must notify the seller in writing (email to hello@herbalyao.com) before the end of the withdrawal period.
Returns must be made within 14 days of notifying the seller. Returned products must be in their original, unused, sealed condition. The seller will refund the full purchase price (including standard delivery costs) within 14 days of receiving the returned goods or proof of return shipment, whichever is earlier.
The right of withdrawal does not apply to products that have been opened and used, given the health and hygiene nature of cosmetic products.
8. Product safety and cosmetic compliance
All products sold on this website comply with EU Regulation (EC) No 1223/2009 on cosmetic products. Products have been assessed by a qualified safety assessor. Full INCI ingredient lists are available on each product page. If you experience an adverse reaction to any product, discontinue use immediately and consult a dermatologist. Please report any serious adverse reactions to hello@herbalyao.com.
9. Warranties and liability
The seller provides a legal warranty of conformity under EU law. If a product is defective or does not conform to its description, the buyer may request repair, replacement, or refund within 2 years of delivery. To exercise this warranty, contact hello@herbalyao.com with proof of purchase and a description of the non-conformity.
The seller's liability for any claim arising from these terms is limited to the purchase price of the relevant product(s). The seller is not liable for indirect, incidental, or consequential damages.
10. Intellectual property
